How Bench Warrants Work in Union County
A bench warrant is judge-ordered arrest process, usually tied to a missed appearance or some other duty the court imposed. In Union County, Form 9-212C lists the trigger facts: failure to appear as ordered, subpoena failure, release-condition problems, contempt, unpaid fines or costs, probation conditions, first-offender-program failure, and more. The AOC FTA procedure narrows that formal workflow. It covers a hearing or criminal summons the judge ordered, and it says some failures to report to probation, specialty court, or jail, and some failure-to-pay summons, should not be entered as an FTA warrant. Exact court wording matters here. The criminal forms index links the blank form family that spells this out.
Union County's 9-212C Trigger List
Form 9-212C is a court process document. It is not a public warrant roster for Union County. The form names the court, the case caption and number, defendant fields, the charging police department, the charges, the trigger facts, the judge's signature, and the officer return. A completed form for one person stays with the court.
- FTA
- Failure to appear as ordered by the court.
- Bench warrant
- Judge-ordered arrest process tied to court noncompliance.
- Recall
- A court action that ends or changes the warrant's enforcement status.
- Bond route
- The release condition written by the court, which may differ from fine payment.
The form may show a bond amount and a bench-warrant fee route. It may instead give a payment route for an eligible traffic or citation matter. No current Union County amount is published.
Bench Warrant Issuance in Union County
First the court identifies the missed duty and reviews the record. Then it enters the process. An automated participating court can send a warrant event to DPS, and the court later records service or cancellation. A public Case Lookup screen may show only part of that chain in Union County. Rule 6-205 says the court should avoid issuing, or leaving in place, a warrant when the person never got proper notice. It also separates some underlying-charge arrest warrants from FTA bench warrants. If notice never reached you, tell the clerk and your counsel. An online screen cannot decide that notice question for you.
Notice and Rule 6-205
The current New Mexico criminal rule puts notice inside the court's own review. It also has the judge weigh FTA history and other factors when setting an appropriate bond. That does not hand you a self-help result. It gives you a reason to ask the issuing court in Union County what the record shows and what appearance is available. The official Rule 6-205 text is the source for the bench-warrant and underlying-charge distinction.
Note: A missed date, a missed payment, contempt finding, and an underlying arrest warrant are not interchangeable labels.
How Bench and Arrest Warrants Differ
Both kinds can put a person in custody. The reason differs. A bench warrant in Union County centers on a court obligation, while an arrest warrant centers on a criminal charge and probable-cause process. The issuing judge and the case event control which one you face.
| Question | Bench warrant | Arrest warrant |
|---|---|---|
| Main trigger | FTA or court noncompliance. | Criminal charge and probable cause. |
| Useful first call | Court that set the hearing or obligation. | Court tied to the criminal process, often District or Magistrate. |
| Possible next step | Reset, recall, appearance, bond, or payment plus court action. | Counsel, scheduled appearance, surrender, or bond under the court's order. |
| Public search limit | Case Lookup may show an event but not the whole document. | Case Lookup may show context, not the warrant document. |
Three Union Courts Issue Bench Process
Union County splits bench process among three courts. District Court is the general-jurisdiction court for felony criminal, child-support, domestic-relations, and other listed matters. Clayton Magistrate Court takes misdemeanors, DWI/DUI, traffic, civil cases under $10,000, and felony preliminary matters. Clayton Municipal Court covers petty misdemeanors, traffic, DWI/DUI, and town ordinances.
Call the court printed on the Union County case papers. A criminal warrant question never belongs at the county recorder's office.
Clearing a Bench Warrant in Union County
Search Case Lookup and identify the court. Then ask the clerk whether the bench warrant is still active. The clerk may route the matter to a judge, a scheduled hearing, Court Compliance, bond, payment, or an attorney. Union County publishes no safe-surrender window, jail bond counter, current bond schedule, or local recall filing fee.
Before appearing: Call the issuing court and ask what to bring, where to go, and whether a judge must review the case. Do not assume a generic walk-in arrest path guarantees same-day release.
Keep every paper. That means the receipt, signed order, cancellation notice, new hearing date, and proof of any payment. Clearing the warrant does not itself dismiss the Union County case or end probation, fines, or other conditions.
Union Cancellation Events Explained
Court Operations publishes a Bench Warrant Cancellation appendix, and the AOC procedure uses a "Warrant Cancelled" event. An automated cancellation may go to DPS. A served event is not the same as a cancellation. A financial payment differs from both. The Court Compliance Unit is described as a primary contact for outstanding Magistrate bench warrants, though no direct Union County number appears. Ask Clayton Magistrate Court whether that unit is part of your case route. The Court Operations page describes this cancellation process on its own official terms.

That resource is statewide process material, not one person's warrant record. Confirm local status with the issuing clerk in Union County.
Which Union Courts Issue Bench Warrants
The court listed on the paper controls the warrant. A District matter stays with District Court. A state traffic or misdemeanor matter belongs with Clayton Magistrate Court, and a town citation or ordinance matter with Clayton Municipal Court. Union County has several routes because jurisdiction splits by case type. The Eighth District docket index separates District and Magistrate calendars. A docket shows hearings, but it is not a full active-warrant list.
Note: The court that issued the process is the office to ask about bond, notice, recall, cancellation, and the next setting.
Union County FTA Scam Warning
The Eighth District warns that New Mexico courts never call, email, or use bonding companies to demand money over warrants or jury-duty failures. A caller threatening immediate arrest is running a scam. A payment link is not a substitute for the court's published number. Hang up and check with the Union County court directly.
Verify first: Hang up, do not provide payment details, and call the issuing court or the Sheriff's Office at a number found on an official page.
For service or custody questions, the Union County sheriff answers. Legal status and release terms belong to the issuing court.
